BOARD OF APPEAL & EQUALIZATION MEETING

MAY 13, 2009

 

The May 13, 2009 Board of Appeal and Equalization Meeting of the Town of Crane Lake was called to order by Chairman Jerry Pohlman at 1:10PM at the Crane Lake Chapel Fellowship Hall with the Pledge of Allegiance recited by those in attendance including:  Supervisors Jerry Pohlman and Butch Eggen, Treasurer Terrie Hoff, Clerk Jo Ann Pohlman, Township Assessor Richard Vidmar, St. Louis County Representative Ben Thomas and 2 members of the community.  Supervisor Jim Janssen arrived at 2PM.

 

Chairman Jerry introduced the Board, Township Assessor Richard Vidmar and St. Louis County Representative Ben Thomas to those present.  Ben Thomas explained that valuations and classifications could be appealed at the meeting.

 

John & Judy Bowers, Parcel Code 308-0030-01942 did not appeal either classification or valuation of their property.  They were at the meeting for information only.

 

The following letters were presented for appeal:

 

Robert & Shirley Congdon, Parcel Code 308-0080-00400 appealed the valuation on their mobile home.  A motion was made by Butch, supported by Jerry to decrease the valuation on the Congdon mobile home from $18,400 to $15,800; a decrease of $2,600 due to age and condition.  All voted in favor and the motion carried.

 

William & Deena Congdon, Parcel Code 308-0080-00406 appealed valuation of property.  A motion was made by Jerry, supported by Butch to reduce the valuation on the William Congdon property from $529,800 to $521,200; a reduction of $8,600 as second well and septic on property was removed.  All voted in favor and the motion carried.

 

Charles & Donna Crockett, Parcel Code 308-0060-00210 appealed valuation of property.  A motion was made by Jerry, supported by Butch that valuation of the Crockett property remains the same as the valuation is comparable to others in the area.  All voted in favor and the motion carried.

 

Delos & Diane Finch, Parcel Code 308-0150-00290 appealed valuation of property.  A motion was made by Butch, supported by Jerry to reduce the valuation on the Finch property from $491,900 to $395,000; a reduction of $96,900 because of short sale. All voted in favor and the motion carried.

 

Robert S. Gilman, Parcel Code 308-0131-00140 appealed valuation of property.  A motion was made by Jerry, supported by Jim to reduce the valuation on the Gilman property from $421,500 to $375,000; a reduction of $46,500 to equalize with other properties in the neighborhood.  All voted in favor and the motion carried.

 

Richard & Nancy Harvey, Parcel Code 308-0030-01845 wrote letter of complaint.  The following explanation will be sent to Mr. Harvey:  The Limited Market Value has been decreasing each year and has sunsetted for tax year 2009, payable in 2010 statewide along with the 10% cap.   Taxes are now based on the Estimated Market Value, which has not increased in three years.  Parcel values were assessed on sales in the area between October 1, 2007 and September 30, 2008, which was prior to sale price decreases.  Any decrease in value may be reflected in future years.

 

Barbara & Orville Heil, Parcel Code 308-0150-00210 appealed valuation of property.  A motion was made by Butch, supported by Jerry to reduce valuation on the Heil property from $341,000 to $300,000; a reduction of $41,000 to equalize with other properties in the neighborhood.  All voted in favor and the motion carried.

 

Bernard Hofschulte, Parcel Code 308-0060-00370 appealed valuation of property.  A motion was made by Jerry, supported by Jim that valuation of the Hofschulte property remains the same as valuation is comparable to others in area.  All voted in favor and the motion carried.

Jon & Margaret Jarvinen, Parcel Code 308-0000-09679 appealed valuation of property.  A motion was made by Jim, supported by Jerry that valuation remains the same as valuation is comparable to others in the area.  All voted in favor and the motion carried.  The valuation increased due to new construction valued at $24,500; actual valuation was dropped by $500.

 

John Mallow, Parcel Code 308-0050-00030 appealed valuation of property.  A motion was made by Butch, supported by Jim that valuation of the Mallow property remains the same as valuation was comparable to others in the area.  All voted in favor and the motion carried.

 

Robert P. Steiner, Parcel Code 308-0050-00060 appealed valuation of property.  A motion was made by Jerry, supported by Jim that the valuation of the Steiner property remains the same as valuation was comparable to others in the area. All voted in favor and the motion carried.

 

John Nayden, Parcel Code 308-0131-00080 appealed valuation of property.  A motion was made by Butch, supported by Jim to reduce the valuation on the Nayden property from $306,500 to $275,000; a reduction of $31,500 to equalize with other properties in the neighborhood.  All voted in favor and the motion carried.

 

Don Nightingale, Parcel Code 308-0000-09659 appealed the valuation of property.  A motion was made by Jerry, supported by Jim to reduce the valuation on the Nightingale property from $169,900 to $113,100; a reduction of $56,800 as per Mr. Vidmar’s recommendation due to error in calculation of percent of building completion.  All voted in favor and the motion carried.

 

Mary & David Parker, Parcel Code 308-0130-00120 appealed the valuation of property.  A motion was made by Jim, supported by Jerry to reduce valuation of the Parker property from $307,900 to $290,000; a reduction of $17,900 to equalize with other properties in the neighborhood.  All voted in favor and the motion carried.

 

Gloria Purdy, Parcel Code 308-0150-00310 appealed the valuation of property.  A motion was made by Jerry, supported by Butch that the valuation on the Purdy property remains the same as valuation was comparable to others in the area.  All voted in favor and the motion carried.

 

Robert Thiede, Parcel Code 308-0040-02540 appealed valuation of property.  A motion was made by Jerry, supported by Jim that valuation of the Thiede property remains the same as valuation was comparable to others in the area.  All voted in favor and the motion carried.

 

Lenore Wheeler, Parcel Code 308-0030-05016 appealed valuation of property.  A motion was made by Butch, supported by Jim to reduce valuation on the Wheeler property from $105,100 to $75,100; a reduction of $30,000 as land was over valued.  All voted in favor and the motion carried.

 

Gretchen & James Janssen, Parcel Code 308-0080-00415 appealed valuation of property.

J & G Enterprises of Kabetogama LLP, Parcel Codes 308-0080-00401 Records 1 & 2; 308-0080-00408 appealed valuation of property.  A motion was made by Jerry, supported by Butch that the valuations on the Janssen and J&G Enterprises properties remain the same.  All voted in favor and the motion carried.

 

Pohlman Family Limited Partnership, Parcel Codes 308-0030-03250, Records 1, 2, and 3; 308-0030-03310 appealed valuation of property.  A motion was made by Jim, supported by Jerry that the valuations on the Pohlman Family Limited Partnership properties remain the same.  All voted in favor and the motion carried.

 

Town of Crane Lake Board of Appeals Meeting Minutes – May 13, 2009

 

Jeff & Lori Sanborn, Parcel Codes 308-0030-03282 Records 1, 2, 3, & 4; 308-0030-03283 appealed valuation of property.  A motion was made by Jerry, supported by Butch to reduce valuation of the Sanborn properties as recommended by the CountyAssessor’s Office as follows:  PC 308-0030-03282 Record 1 from $150,400 to $127,500; a reduction of $22,900.  Same PC, Record 2 from $915,800 to $710,200; a reduction of $205,600.  Same PC, Records 3 and 4 remain the same.  PC 308-0030-03283 from $736,900 to $569,900; a reduction of $167,000.  All reductions made due to parcels being valued as contiguous parcel.  All voted in favor and the motion carried.

 

The following information, provided by Ben Thomas, will be included with each response to the above appeals:  The Limited Market Value law has “sunset” statewide.  Beginning assessment year 2009, taxes payable 2010, taxes are based on Estimated Market Value.  In the Town of Crane Lake, Estimated Market Values have not changed in three years (except 1/5 of the township is revalued each year).  For the 2009 assessment, values are based on sales that occurred between October 1, 2007 and September 30, 2008 (state defined “Sales Ratio Study” period).  State law requires that, on average, assessor’s values must be between 90% and 105% of actual sale prices.  If sales that occur between October 1, 2008 and September 30, 2009, indicate that, on average, the assessor’s Estimated Market Value is more than 105% of actual sale prices, Estimated Market Values will be decreased township wide for the 2010 assessment.”

 

 

No list of Crane Lake Building Permits 2009 Assessment was presented for Board consideration.
